TEN YEARS RIGOROUS IMPRISONMENT TO ACCUSED RELATED TO DEATH OF A BRITISH MINOR GIRL

The Goa Bench of High Court of Bombay today sentenced  Samson D’Souza (private person) to undergo ten years Rigorous Imprisonment with a total fine of Rs. 2.60 lakh, in a case related to death of a minor girl (a British National). The Court also ordered that the amount of fine be paid to the mother of the victim.

CBI had registered a case on 05.06.2008 in pursuance of Govt. of India Notification dated 28.05.2008 and taken over the investigation of FIR No. 21/2008 dated 09.03.2008, earlier registered at Police Station Anjuna (Goa) against Samson D’Souza and Placido Carvalho, both private persons, U/s 302 of IPC. It was alleged that on 18.02.2008, the Anjuna Police received information from an unknown caller about a female dead body floating in the sea at Govekarwaddo, near Shore Bar, Anjuna (Goa). Accordingly, the dead body was recovered and was identified as that of a minor girl, aged about 15 years 8 months. Goa Police filed a chargesheet against Samson D’Souza and Placido Carvalho on 31.05.2008.

CBI conducted thorough investigation in the matter and filed a chargesheet against the accused Samson D’souza and Placido Carvalho on 21.10.2009 in the Children’s Court, Panaji (Goa).

On 23.09.2016, the Children’s Court, Panaji pronounced the judgment acquitting the two accused persons.

CBI then filed a Criminal Appeal before the Hon’ble High Court of Bombay at Goa against the Order dated 23.09.2016 of the Children’s Court, Panaji.

The Hon’ble High Court of Bombay at Goa on 17.07.2019 convicted the accused Samson D’Souza U/s 328,354,304(II) and 201 of IPC & U/s 8 of the Goa Children Act and acquitted the other accused Placido Carvalho.
