DELHI EOW NABS CARE TAKER SOLD PROPERTY ON FORGED SALE DEED

Economic Offences Wing, Delhi Police has arrested Bhupender Singh Chauhan S/o Mahender Singh Chauhan R/o 4290/3, Ansari Road, New Delhi-110002 who was appointed as Authorised Representative by Mr. Ramesh Chandr Jain with regard to appearing before Civil Court in respect of litigations of the property No. 71 Garstin Bastion Road, New Delhi in FIR No. 108/19 dt 14.06.19 U/s 420/467/471/120B IPC PS EOW. 

Dr. O.P. Mishra, Joint Commissioner of Police, Economic Offences Wing, said,  complainant Yogesh Naraina Gupta stated that he is the registered owner of the property No. 71 Garstin Bastion Road,G.B. Road, New Delhi. The said property is registered in his name vide sale deed No. 1772, volume No. 11896, page No. 176 – 293, registered at Sub-Registrar, Asaf Ali Road, New Delhi on 22.02.2006.

Bhupender Singh Chauhan, the accused person who was appointed as Authorised Representative by Ramesh Chander Jain with regard to appearing before the court in respect of pending litigation with regard to the property 71 G B Road, New Delhi. Mr. Bhupender Singh Chauhan, GPA holder of Mr. R.C. Jain executed sale deeds of the respective portions of the property in question to the tenants Smt. Usha Devi, Narender Bhatia and Aahasan Mohd and received sale considerations in his accounts.

It is alleged that one Bhupendra Singh Chauhan r/o 4290/3, Ansari Road, Daryaganj, New Delhi, AR of Ramesh Jain, sold part of his property to one Usha Devi w/o Ramesh Srivastava, Ahsan Mohd. & Narendra Bhatia illegally. The sale deeds have been executed in connivance with the Sub-Registrar, Asaf Ali Road, New Delhi, who was well acquainted with the facts of the property and pending litigations ongoing in the court. He sold the said property to the co-accused persons namely Narender Bhatia, Usha Devi and Ahsaan Mohd who were tenants in the said property and depositing rent with the court.

A case vide FIR No. 108/19 dt 14.06.19 U/s 420/467/471/120B IPC was registered at PS EOW and investigation of the same was taken up under the leadership of DCP/EOW and close supervision of Sh. Amar Deep Sehgal, ACP/EOW.

Mr. Bhupender Singh Chauhan, GPA holder of Mr. R.C. Jain executed sale deeds of the respective portions of the property in question to the tenants Smt. Usha Devi, Narender Bhatia and Aahasan Mohd and received sale considerations in his accounts.

Mr. Ramesh Chandr Jain has denied giving any instructions to sell the property to the tenants. From the perusal of the General Power of Attorney dated 06.10.11 it has been revealed that the accused had never been authorized to execute sale deed to other persons. He also revoked the power of attorney dated 06.10.11. The Hon’ble Court of Ld. CJ-07 SH. Rahul Verma, Tis Hazari Court, Delhi vide order dated 21.10.2019 in the case title Ramesh Chandr Jain Vs Yogesh Narain Gupta in CS SCJ No. 99067/16 restrained Mr. R.C. Jain/ his attorney/ agent from selling /creating third party interest in the property.

Accused Bhupender Singh Chauhan in connivance with the tenants Smt. Usha Devi, Narender Bhatia and Aahasan Mohd., fraudulently without having any authority executed the registered sale deed in their names. 

A team consisting of SI Gaurav, ASI Yashpal and Ct. Vipin under the leadership of Sh. Amar Deep Sehgal, ACP/EOW and overall supervision of Sh. Mohammed Ali, DCP/EOW arrested Bhupender Singh Chauhan on 01st March, 2021.
Further investigation of the case is in progress.
