TIHAR JAIL PREMISES MISUSED BY UNITECH DIRECTORS SANJAY CHANDRA AND AJAY CHANDRA, 32 TIHAR JAIL EMPLOYEES BOOKED

APEX COURT HAD ALSO DIRECTED THE COMMISSIONER OF POLICE, DELHI TO MAKE AN IMMEDIATE ENQUIRY IN THE MATTER. AFTER ENQUIRY, ON 28.09.2021, REPORT WAS SUBMITTED BY COMMISSIONER OF POLICE, DELHI IN THIS REGARD.,THE ED HAD ACCUSED THE BROTHERS — WHO WERE ARRESTED FOLLOWING COMPLAINTS OF SIPHONING HOMEBUYERS’ MONEY — OF “ENGAGING IN ILLEGAL ACTIVITIES BY FLOUTING THE JAIL MANUAL… MAKING TRANSFERS OF ASSETS AND DISSIPATING THE PROCEEDS OF CRIME… INFLUENCING WITNESSES, AND ATTEMPTING TO DERAIL THE INVESTIGATION”. THRY WERE LODGED IN TIHAR JAIL BUT JAIL AUTHORITIES ALLOWS THEM  A FREE RUN AND WERE “FLOUTING THE JAIL MANUAL”

During the course of hearing, the Hon’ble Apex Court took note of the status report filed by the Enforcement Directorate (ED), which highlighted certain disturbing facts relating to the manner in which the premises of Central Jail Tihar had been misused by jail inmates Mr. Sanjay Chandra and Mr. Ajay Chandra. The Hon’ble Supreme Court transferred both the brothers from Central Jail Tihar, Delhi to Arthur Road Jail, Mumbai and Taloja Central Jail, Mumbai.

Meanwhile Delhi Police Crime Branch on Tuesday registered a case after 32 officials of Tihar Jail number 7 were found to be complicit with Unitech’s imprisoned ex-promoters Ajay Chandra and Sanjay Chandra, officials said on Tuesday.

The Supreme Court had on October 6 directed suspension of Tihar jail officials, registration of case against them and full-fledged probe into their collusion with the jailed promoters, based on Delhi Police Commissioner Rakesh Asthana’s report.  

Civil Appeal i.e. CA 10856/2016 was listed before the Hon’ble Supreme Court of India on 26.08.2021.

The Hon’ble Court had also directed the Commissioner of Police, Delhi to make an immediate enquiry in the matter. After enquiry, on 28.09.2021, report was submitted by Commissioner of Police, Delhi in this regard.

On 06.10.2021, after going through the enquiry report, the Hon’ble Supreme Court granted permission to conduct a full fledged criminal investigation in the matter based on the enquiry conducted. Accordingly, today, i.e. 12.10.2021, an FIR has been registered in Crime Branch under relevant sections of the Prevention of Corrupton Act and Indian Penal Code, and investigation has been taken up.

The Hon’ble Supreme Court had also directed that the officials of Tihar Jail who have been prima facie found to be complicit in the course of the Enquiry to be placed under suspension and had further directed the Union Ministry of Home Affairs to respond to the suggestions which were contained in the report submitted by Commissioner of Police, Delhi.

During enquiry, thirty two (32) officials of Tihar Jail No. 7 were found to be complicit with Ajay Chandra and Sanjay Chandra in this matter.

Accordingly, letters have been sent to the Director General, Tihar Jail and Home Ministry for further necessary action in this regard. 

It may be recalled that Last week Sanjay Chandra’s wife Preeti Chandra and his father Ramesh Chandra were arrested by the ED in connection with the Unitech money laundering case.
