TRANSFER MC, MTP & CONDUCT PROBE INTO ILLEGAL BUILDINGS: CoE TO GUV

The Council of Engineers (CoE) has approached Hon’ble Governor of Punjab for directions to the Chief Secretary of Punjab to transfer Municipal Commissioner Mr. Pradeep Kumar Sabharwal as well as Municipal Town Planner Mr. Surinder Bindra and to conduct an independent probe into complete failure of Government of Punjab on surging illegal buildings in Ludhiana. 

Er. Kapil Arora informed that as per report prepared by the Additional Commissioner of MCL, there are 57,862 illegal buildings based on new electrical connections issued by PSPCL with respect to building plans approved and challans issued by MCL but this report is incomplete as such report doesn’t include construction of more storeys over buildings having old electrical connections as well as residential buildings illegally constructed as Commercial and Industrial with covered area much more than building byelaws in active connivance Municipal Commissioner, MTP, ATPs and Building Inspectors. Further the type of building is not mentioned in large number of Challans issued by ATPs. 

Er. Mohit Jain informed that both Municipal Commissioner as well as Municipal Town Planner have even failed to act on encroachment of land of Nallah (Drain) at Main Chaura Bazar Ludhiana.. Their inaction indicates that MC & ATPs both are in active connivance to all such illegal activities going on in Ludhiana which has resulted into huge loss to exchequer (Public Money), thus an independent probe is need of the hour. 

Er. Er. Gagnish Khurana said that due to illegal buildings with more covered area than building byelaws as well as without any approved plan have increased burden on already crumbled infrastructure of Ludhiana and thus it is against Article 21 of Constitution of India for Citizens (residents) of Ludhiana. The entire building plan system has collapsed again and the Local Government Department is silent on this issue. 

Er. Rajinder Bhutani said that despite directions of Hon’ble High Court as well as provisions of Building Byelaws for criminal action against erring officers, no action has been taken by Municipal Commissioner as well as MTP. Further Punjab Government is also protecting the erring and corrupt officers by introducing regularization policy again and again.

It is pertinent to mention here that despite a report prepared by the Additional Commissioner, no action was sought by Municipal Commissioner as well as MTP on erring Assistant Town Planners and Punjab Govt. came up with another regularization policy in November 2021 to shield the violators as well as illegal criminal acts of corrupt officers but Council of Engineers approached the Hon’ble Governor in time and such policy has not been approved. 

Er. Kapil Arora added further that since Punjab Govt. as well as Local Government Department have failed to perform their lawful duties, we have again approached Hon’ble Governor for directions to the Chief Secretary of Punjab to transfer both MC & MTP and conduct probe into role of all concerned officials for allowing such gross violation in the City which has resulted into huge loss of Public Money and unhealthy environment for residents of Ludhiana.
