CHANDIGARH POLICE ARRESTED AFGHAN NATIONAL ILLEGALLY STAYING WITHOUT VISA

In a significant development, under the direction of Ms. Kanwardeep Kaur IPS W/SSP UT, Chandigarh, Ms. KM Pryianka, SP/City, and in the close supervision of Sh. Vijay Singh, SDPO/North-East, and Inspector/SHO Hariom Sharma, Police Station-Mauli Jagran, team of Police Station Mauli Jagran headed by SI Sham Sunder and other police officials successfully arrested one Afghani accused person in Foreigner Act Case.In this regard Case FIR No. 59, dated 14.07.2025 U/s 14 Foreigners Act & 318 BNS, Police Station-Mauli Jagran, UT, Chandigarh,, have been registered.

This case has been registered on the Complaint/Letter No. 11/FRRO/REG/ASR/2025-194 dated 05.03.2025, from FRRO Amritsar wherein mentioned that it has been observed that during enquiry Mr. Mohammad Rasool Barak s/o Mahammad Afzal traced out and his statement also recorded in which he stated that he is a permanent resident of Kandahar, Afghanistan and in the year 2015 he comes to India on Student Visa till the validity of 2016.

After that his visa was further extended for 02 years and in the year 2018 he passed Graduation for Panjab University He further stated that from last 04 years he is residing in India as a Refugee as his visa had already been expired and he is working as a taxi driver

Mohammad Rasool Barak stated that he does not want to go back his native country Afghanistan due to abnormal situations During the course of discreet enquiries it has been learnt that the above said foreign origin has falsely claimed as Indian in his application form for learner's license (LL) Registration & Licensing Authority, UT, Chandigarh and also made/procured other Indian Identity documents in his name is as under-

1. Adhar Card 6827-4200-6461 2. PAN Card ENLPB3046M 3. Driving Licence CH0120200008886, DOL-26.11 2020 Valid till 25.11.2030.

Mohammad Rasool Barak stated that he does not want to go back his native country Afghanistan due to abnormal situations During the course of discreet enquiries it has been learnt that the above said foreign origin has falsely claimed as Indian in his application form for learner's license (LL) Registration & Licensing Authority, UT, Chandigarh and also made/procured other Indian Identity documents in his name is as under-

As per visa Manual, a foreigner on Student Visa is not permitted to be involved in any employment/business activities and any deviation may lead to visa violation and attract penal action under the 14 Foreigners Act-1946.

Further the Afghan nationals are misusing the loopholes of the system to forge their real identity which is matter of national security. According to certified copies of these documents received from RLA/UT Chandigarh Mr. Mohammad Rasool Barak, an Afghan national while applying for Learner's License H. No. 3059, Raipur Khurd, Chandigarh, mentioned his place of birth as Chandigarh, country of birth India and Aadhar Card No. 682742006461, where as he is an Afghan national, born on 13.08.1988 at Kandahar (Afghanistan).

After discussions with senior officers and verification of the relevant facts, it has been found that Mohammad Rasool Barak has violated the rules Governing Passports. Accordingly, a case FIR, U/S 14 Foreigners Act & 318 BNS, has been registered against alleged Mohammad Rasool Barak S/o Mahammad Afzal, R/о H.No 102, old Raipur Khurd, Mauli Jagran, Chandigarh age- 37 years (holding Passport No. P02773924). 

During the course of investigation, accused Mohammad Rasool Barak S/o Mahammad Afzal, R/о H.No 102, old Raipur Khurd, Mauli Jagran, Chandigarh age- 37 years has been arrested from Police station- Mauli Jagran, Chandigarh on Saturday. Afghani accused person Mohammad Rasool Barak was produced before the Hon’ble Court and sent to 14 days Judicial custody. The case is in initial stage. The further investigation is going on.
