JUSTICE AFTER 32 YEARS: CBI COURT MOHALI SENTENCES THEN SHO, JHABBAL TO 10 YEARS’ RI WITH FINE OF Rs. TWO LAKH

CBI CASE RELATED TO EXTRA JUDICIAL KILLING

The Court of Special Judge, CBI Cases, Mohali, Punjab, has sentenced accused Shri Amarjeet Singh, then SHO, PS Jhabbal, Amritsar to Rigorous Imprisonment (RI) of 10 years with fine of Rs two lakh, in a case related to extra judicial killing of Balwinder Singh. The matter was also referred to DLSA for due compensation to the family.

The Hon’ble Supreme Court vide order dated 15/11/1995 had directed CBI to investigate allegations of extra judicial killings and disposal of dead bodies as lawaris/ unclaimed by officials of Punjab Police.

Initially, CBI registered Preliminary Enquiry and during enquiry wife of a victim came forward and deposed that her husband Balwinder Singh was illegally apprehended/ detained by Police team of Jhabbal PS on 04.10.1992. She apprehended that Police officials had killed Balwinder Singh and cremated him as Lawaris Dead Body. Accordingly, CBI registered a case against Shri Ashok Kumar Sharma, DSP, Shri Amarjeet Singh SI/ SHO, PS Jhabbal & others.

On completion of the investigation, CBI filed a charge-sheet in the Court of Special Judge, CBI Cases, Mohali, Punjab on 16.09.1999 against accused Shri Ashok Kumar Sharma, DSP and Shri Amarjeet Singh, then SI/ SHO, PS Jhabbal. Charges were framed against both accused on 28/02/2000. During trial, DSP Ashok Kumar Sharma expired and charges against him were abated.

After trial, the Court held accused Amarjeet Singh, then SI/ SHO, PS Jhabbal guilty and sentenced him accordingly.
