CHANDIGARH ADMINISTRATION ISSUES ORDER FOR DEMOLITION OF UNAUTHORIZED CONSTRUCTION IN KAIMBWALA

In compliance with the orders dated 15 May 2024 by the Hon'ble Punjab & Haryana High Court, Chandigarh, an order has been issued by the Sub Divisional Magistrate (Central) under Section 12(2) of the Punjab New Capital (Periphery) Control Act, 1952, for the demolition of an unauthorized structure in Kaimbwala village, U.T., Chandigarh.

The structure measuring 12' x 20' is a liquor shop constructed on agricultural land (Khasra No. 22//7-14) in the periphery area of Kaimbwala village, which is declared as a controlled area. This construction contravenes Sections 5, 6, and 11 of the Punjab New Capital (Periphery) Control Act, 1952.

A notice was issued on 6 May 2024, giving the violator an opportunity to present their case on 15 May 2024. Despite multiple opportunities, no satisfactory reply was submitted. During the hearing, it was contended by the Naib Tehsildar (Periphery) that the structure is also unauthorized, falling within the Sukhna Catchment area, as per the Orders of the Hon'ble Punjab and Haryana High Court in CWP No. 18253 of 2009 dated 2 March 2020.

Deputy Commissioner Vinay Partap Singh said that to ensure effective actions against fresh illegal/unauthorised constructions and encroachment in the periphery the Chandigarh Administration is adopting a ZERO tolerance policy. He further said that the general public is again requested not to undertake any fresh building violations/encroachment in the periphery otherwise the same is liable to be demolished

In accordance with Section 12 of the Act, the Sub Divisional Magistrate (Central) has directed the violator to demolish the unauthorized construction within six weeks from the issuance of the order and restore the land to its original state. Failure to comply will result in the administration taking necessary measures for demolition, and the cost of such demolition will be recovered as arrears of land revenue.
