The Ld. Special Judge, CBI, West, Lucknow has convicted and sentenced the accused Pankaj Khare, Deputy Chief Manager, Bank of India, two private persons namely Rajesh Khanna and Shamshul Haq Siddiqui to 3 Years Imprisonment with a fine of Rs. 1.25 lakh each in a Bank Fraud Case of Rs. 6.8 Crore. Also Rs. One lakh fine has been imposed on the accused private company M/s Anita Contractor and Construction Private Limited in the case.
The Central Bureau of Investigation (CBI) registered the instant case on 09.07.2008 on the basis of complaint of Assistant General Manager, Bank of India, Main Branch, Hazratganj, Lucknow on the allegation that during the period 2004 to 2006, accused persons entered into criminal conspiracy with others and cheated Bank of India, Lucknow Branch by availing cash credit facility on the basis of forged and fabricated non-existent work orders, submitted forged property documents for creation of equitable mortgage and utilized the amount for purposes other than for which it was sanctioned and thereby caused wrongful loss to the bank to the tune of Rs. 6.80 crore and corresponding wrongful gain to themselves.
After investigation, CBI filed chargesheet on 23.12.2009 against 1. Anita Jain, Managing Director of M/s Anita Contractor and Construction Private Limited. 2. Mohd. Isteyaq Khan, Pvt. Person. 3. Pankaj Khare, Deputy Chief Manager, Bank of India. 4. Poonam Sinha, Pvt. Person,5. Prem Prakash Asthana, Chief Manager, Bank of India, 6. Rajesh Khanna, Pvt. Person, 7. Shamshul Haq Siddiqui, Pvt. Person 8. Sudhir Kumar Jain, Properitor of M/s Jamuna Construction Company & Director of M/s Anita Contractor and Construction Private Limited and 9. M/s Anita Contractor and Construction Private Limited. (through Anita Jain).
The Hon’ble Court, after the trial, convicted and sentenced the accused accordingly. Proceedings against Prem Prakash Ashthana and Smt. Poonam Sinha have been discharged by the Ld. Trial Court. Sudhir Jain and Mohd. Isteyaq Khan expired during the trial of the case.Ld. Trial Court has acquitted Smt. Anita Jain from all the charges levelled against her on the ground of benefit of doubts.
