DEATH DUE TO NEGLIGENCY OF DOCTOR IN FORTIS HOSPITAL MOHALI

District Consumer Disputes Redressal Commission Chandigarh has imposed a fine of Rs 50 lakh on Mohali based Fortis Hospital and its doctor Mohnish Chhabra. The commission has given this decision against the hospital on the charge of death of a patient due to negligence.
The complainant Priyanka Sharma held the hospital responsible for the death of her husband Harit Sharma and filed a case in the consumer commission. In this case, a note written by Harit Sharma with a pen on paper before his death proved to be an important evidence. In this, he had written about the negligence of the doctors.
The doctors had shown some negligence in his treatment, about which he had heard the doctors talking among themselves. He had an oxygen mask on his mouth but he was fully conscious. When his wife came to the hospital, he asked for a paper and pen through gestures and wrote the entire incident on it.

Deceased wife presented this paper before the commission as evidence, which the court accepted and held the hospital guilty of negligence in service. The hospital rejected the allegations and said that the patient was suffering from serious liver disease and had been consuming alcohol for a long time. The doctors had treated him as per their expertise and no negligence had been committed, hence, he sought dismissal of the case, but the forum announced its decision.
