A local court has acquitted a senior citizen in a cheque bounce case. Rajiv kumar sharma residence of Sector 44, Chandigarh, in its petition, said he has given loan to Mangat Ram of Sector 22 Chandigarh. Mangat Ram Counsel of Danishwar Ali and Mohd Uzair Advocates argued that, Mangat Ram never took any loan from the complainant, rather the cheques in question were given to the complainant for business purposes, which have been misused by the complainant.
Counsel further argued that after gaining knowledge of dishonest character of complainant, accused withdrew the amount from bank. Further Danishwar Ali and Mohd Uzair Advocates argued that there is no receipt on record to show that any amount was advanced to the accused.
Complainant has not filed any Income Tax Return to show source of funds.
The court of Ms Divya Sharma, JMIC, observed that the court is of the considered view that complainant has failed to prove on record factum of existence of legal liability of accused and the issuance of cheque in question to discharge that liability,
And accused Mangat Ram has not committed an offence punishable under Section 138 of the Act. Accordingly, Mangat Ram stands acquitted of the notice of accusation framed against him under Section 138 of the Act.
