DELHI HIGH COURT REVERSES DISCHARGE OF RAMAN KUMAR, LOVELY, ORDERS FRAMING OF CHARGES IN ONLINE CHILD SEXUAL ABUSE CASE

Hon’ble High Court of Delhi vide order dated 04.04.2026 has reversed the order of the trial court discharging two accused persons namely Raman Kumar and Sandeep Singh@ Lovely in Online child sexual abuse case and ordered for framing of charges.

The case was registered by CBI against Raman Gautam and other unknown persons for commission of offences transmitting, storing, and viewing Child Sexual Exploitation Material by sharing links, videos, pictures, texts, and posts, and by hosting such content on social media platforms. 

A Charge sheet was filed under relevant sections of IT Act & section 15(2) of POCSO Act against aforesaid accused. However, trial court discharged the accused from the offences punishable u/s 15(2) of POCSO Act, on the grounds that the children in the alleged pornographic videos (CSAM) are unidentified and mandatory criteria for determining the age of the children are not fulfilled. 

The trial court order discharging the accused was set side by High Court.
